Are Your Faucets Rusty or Constantly Leaking? Your Home May Be Violating the Law!

If you live in California and have noticed that your faucets are rusty or leak continuously, your home may not meet the habitability standards established by state law.

According to Section 1941.1 of the California Civil Code, a rental property must have plumbing facilities in good working order, providing both hot and cold running water.

Rusty or leaking faucets are more than just a minor annoyance they may be signs of deeper plumbing issues, such as corroded pipes or hidden leaks. These problems can affect water quality, increase your utility bills, and in severe cases, cause structural damage to the property. They can also create conditions favorable for mold growth, which poses health risks.

What Can You Do as a Tenant?

  1. Notify Your Landlord in Writing: Clearly communicate the issue to your landlord and document everything. Keep copies of all correspondence.
  2. Request Repairs: You have the right to ask for the necessary repairs to ensure that your plumbing is safe and functional.
  3. Know Your Rights: If your landlord fails to respond within a reasonable timeframe, California law gives you certain options to take further action.

Did You Know You Can Repair and Deduct the Cost from Rent?

If your landlord does not make the necessary repairs within a reasonable period, California law allows you to fix the problem yourself and deduct the cost from your rent. However, this right comes with limits. For example, the cost of the repair must not exceed one month’s rent, and this option may only be used twice in a 12-month period.

Need Legal Help?

If your efforts to resolve the issue have not been successful, it’s advisable to seek legal assistance. There are organizations and attorneys who specialize in tenant rights and can help guide and represent you if needed.

Remember, as a tenant in California, you have rights that protect your health and safety. Don’t hesitate to act if your rental home fails to meet legal habitability standards.
